General Terms and Conditions (GTC)

for the Artist Studio Katerina Belkina

1. Scope and Provider

These Terms and Conditions apply to all contracts, deliveries, and services between the Artist Studio Katerina Belkina, accessible via the website www.belkina.art, and its customers, in the version valid at the time of the order.

Conflicting terms and conditions of the customer shall not apply unless expressly approved in writing by the studio.

 

2. Offers and Conclusion of Contract

The presentation of artworks, photographs, and licenses on the website or in any other media does not constitute a legally binding offer, but rather an invitation for the customer to submit an offer.

By placing an order via the online shop, by email, or through direct purchase, the customer submits a binding offer. The contract is concluded upon express acceptance, e.g., via order confirmation or invoice.

 

3. Prices and Payment Terms

All prices are in euros (€), inclusive of applicable VAT (if levied), and exclusive of shipping costs.

Payment methods include:

  • Stripe (credit card, Apple Pay, etc.) via the online shop

  • PayPal (upon request)

  • Bank transfer (invoice)

  • Cash payment upon collection at the studio

Shipping is initiated only after full payment has been received.

 

4. Delivery, Shipping, and Transfer of Risk

We ship worldwide. In the online shop, the customer may choose a preferred shipping service from predefined options.

Shipping costs and delivery times are specified individually during the order process.

The risk of loss or damage during transport is borne by the artist studio until delivery to the customer.

 

5. Right of Withdrawal / Returns

Right of withdrawal for consumers under distance selling law:

Private customers have the right to withdraw from the contract within 14 days without stating any reason. The withdrawal period begins on the day the customer receives the goods.

To exercise the right of withdrawal, a clear written statement (e.g., via email) is sufficient. The customer bears the return shipping costs. The purchase price will be refunded after receipt of the returned goods.

Exclusion of the right of withdrawal:

The right of withdrawal does not apply to custom-made or personalized artworks specifically commissioned by the customer.

 

6. Retention of Title

All goods remain the property of Katerina Belkina until full payment has been received.

 

7. Copyright and Intellectual Property

All artworks, photographs, texts, and other content on www.belkina.art are protected by copyright and are the intellectual property of Katerina Belkina.

Any reproduction, distribution, or use without prior written consent is strictly prohibited.

The artist holds registered Union trademarks for "Belkina" and "Katerina Belkina." Unauthorized use, copying, or reproduction may be subject to civil and criminal penalties.

 

8. Licensing

Use of artworks in editorial, commercial, or institutional projects requires prior written permission.

Licenses are granted on a case-by-case basis, considering scope, media, duration, and purpose of use.

The usual licensing fee per artwork ranges between €5,000 and €15,000.

Standard pricing models (e.g., MFM tables, stock agencies) explicitly do not apply. All license inquiries must be directed to the studio.

 

9. Liability

The studio is liable for minor negligent breaches of duty only in the event of a violation of essential contractual obligations (cardinal obligations).

In all other cases, liability for slight negligence is excluded.

Liability under the German Product Liability Act and for intentional misconduct remains unaffected.

 

10. Data Protection

The processing of personal data is carried out in accordance with applicable data protection laws.

Personal data is used exclusively for the fulfillment of orders or as per the customer’s consent.

 

11. Jurisdiction and Governing Law

These terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The exclusive place of jurisdiction, to the extent legally permissible, shall be the registered office of the artist studio in Werder (Havel), Germany.

 

12. Final Provisions

If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
